Please read these Terms of Service ("Terms") carefully before using the NexaCareMD website or telehealth services operated by Paramount Medical LLC ("NexaCareMD," "we," "us," or "our"). By accessing our website or submitting an intake form, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our website or services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you do not agree, you may not use our services.
We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance. We will notify active patients of material changes via email.
2. Description of Services
NexaCareMD provides physician-led telehealth services including: - Medical evaluations and consultations via telehealth - Personalized treatment plans for metabolic health, weight management, and cardiovascular risk - GLP-1 management and optimization (when clinically appropriate) - Ongoing physician monitoring and care adjustments
All clinical services are provided by licensed physicians. Services described on our website are informational only and do not constitute a physician-patient relationship until formally established through our intake and evaluation process.
3. Geographic Eligibility
NexaCareMD currently provides telehealth services to patients physically located in Florida and Alabama only. You must be located in one of these states at the time of each consultation. By requesting services, you represent and warrant that you meet this requirement.
It is your responsibility to ensure telehealth services are permitted in your jurisdiction. We do not provide services to patients outside these states.
4. Not an Emergency Service
Important Notice: NexaCareMD is not an emergency medical service. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use our website, forms, or messaging for urgent or life-threatening situations.
5. Medical Disclaimer
The content on this website is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. No physician-patient relationship is established by reading this website or submitting an inquiry. - Evaluation does not guarantee treatment, prescriptions, or acceptance into the program - Medications, including GLP-1 agents, are prescribed only when clinically appropriate based on individual evaluation - Individual results vary and are not guaranteed - You are responsible for disclosing your complete medical history, current medications, and relevant health conditions accurately

6. Fees and Payment
Our services are fee-based and not covered by insurance. By submitting payment, you agree to our applicable fee schedule. Flexible financing available; HSA and FSA eligible Fees and tier details are disclosed prior to enrollment Refunds: Membership fees are non-refundable once care has begun. For cancellation or refund inquiries, contact us within 24 hours of payment We are not responsible for costs related to medications, labs, or third-party services
7. Patient Responsibilities
To receive care from NexaCareMD, you agree to: - Provide accurate, complete, and current information about your health history - Attend scheduled appointments or cancel with reasonable notice - Actively engage in your care and follow your physician's recommendations - Notify us promptly of any adverse reactions, side effects, or changes in your condition - Not use our services as a substitute for emergency care or for conditions requiring in-person evaluation
8. Termination of Services
We reserve the right to decline or discontinue services to any individual at our discretion, including (but not limited to) cases where: - The patient is not clinically appropriate for our services - Accurate medical history has not been provided - The patient engages in abusive, threatening, or inappropriate conduct - Continued care would be outside our scope of practice
You may discontinue services at any time by contacting us. Discontinuation does not affect your obligation to pay for services already rendered.
9. Limitation of Liability
To the fullest extent permitted by law, NexaCareMD and Paramount Medical LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the 90 days preceding the claim.
Nothing in these Terms limits our liability for gross negligence, fraud, or where limitation is prohibited by applicable medical practice law.
10. Intellectual Property
All content on this website — including text, graphics, logos, and images — is the property of NexaCareMD / Paramount Medical LLC and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Florida, and you consent to personal jurisdiction in that venue.
Before initiating legal action, you agree to contact us in good faith to attempt to resolve the dispute informally.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
